Not an offer to sell

The Site is a marketing and informational resource. Nothing on it — including project descriptions, renderings, floor plans, photographs, videos, virtual tours, amenity lists, pricing, availability, square footage, specifications, or delivery or completion dates — constitutes an offer, solicitation, reservation, contract, or guarantee of any kind, and none of it may be relied upon as such.

Renderings, floor plans and photographs are illustrative. They may depict finishes, furnishings, landscaping, views, staging, lighting or weather conditions that differ from, or are not included in, the finished property, and are subject to change without notice as design and construction progress.

Pricing, availability, unit inventory, payment plans, amenities, specifications and estimated delivery dates shown on the Site are indicative, subject to change without notice, and are not binding on Bonita. Prices may be shown in a currency other than Dominican pesos for convenience only; any conversion is approximate and not a quotation. Taxes, closing costs, transfer fees and other charges are not included unless expressly stated.

A binding sale, reservation or purchase arises only under a separate written agreement signed by you and the applicable seller entity. If anything on the Site conflicts with a signed agreement, the signed agreement controls.

Not financial, tax, legal or immigration advice

Nothing on the Site is financial, investment, tax, legal or immigration advice, and Bonita is not acting as your financial, legal or immigration advisor. Any rental yield, return on investment, appreciation, or similar figure shown on the Site is a hypothetical illustration based on assumptions that may not hold, is not a forecast or guarantee of any outcome, and should not be relied upon in making a decision to purchase.

Real estate investment carries risk, including the risk of loss. Residency, visa, tax and repatriation-of-funds consequences of owning property in the Dominican Republic depend on your personal circumstances and on Dominican law as it applies to you. Before making any decision, you should obtain independent advice from a qualified attorney, tax advisor and financial advisor of your own choosing.

Eligibility and your account with us

You must have the legal capacity to enter into a binding contract to submit an enquiry or otherwise transact with Bonita through the Site. The Site is not directed at, and Bonita does not knowingly collect information from, anyone under 16 — see our Privacy Policy.

You are responsible for the accuracy of any information you submit through the Site, including in forms, brochure downloads, tour requests and WhatsApp messages. Bonita may rely on the information you provide without independently verifying it, and is not responsible for any consequence of you providing false, outdated or incomplete information.

By submitting a form or otherwise providing your email, telephone number or WhatsApp contact, you consent to being contacted by Bonita using those channels about the enquiry you made and related properties, subject to your right to opt out at any time as described in our Privacy Policy.

Acceptable use

You agree not to, and not to attempt to:

• Use the Site for any unlawful purpose, or in a way that infringes the rights of Bonita or any third party.
• Scrape, crawl, harvest or systematically extract content, pricing, floor plans or other data from the Site by automated means, other than through standard search engine indexing that respects robots.txt.
• Reproduce, republish, resell, or use for a commercial purpose any rendering, floor plan, photograph, video, price list or brochure obtained from the Site without Bonita’s prior written consent.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Site, its servers, or any system or network connected to it, including by introducing malware or attempting to bypass any security measure.
• Submit false, misleading or fraudulent information through any form on the Site, or impersonate any person or entity.
• Use the Site, or any contact information obtained from it, to send unsolicited commercial communications to Bonita or its personnel.
• Represent yourself as an agent, broker, employee or authorized representative of Bonita unless you are one under a separate written agreement.

Intellectual property

The Site and everything on it — including text, graphics, logos, the names Bonita, Bonita Beach and Bonita Golf, renderings, photographs, videos, floor plans, and the design and organization of the Site — is owned by Bonita or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to view the Site and its content for your personal, non-commercial use in evaluating a possible purchase. No other right or license is granted, whether by implication, estoppel or otherwise.

Bonita, Bonita Beach, Bonita Golf and associated logos are trademarks of Bonita or its affiliates. Other names, logos and trademarks on the Site (including those of amenity or brand partners) belong to their respective owners and are used with permission or under license.

Your submissions

If you send Bonita a testimonial, comment, photograph, video or other content (a "Submission"), whether through a form, email, WhatsApp, or social media, you grant Bonita a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to use, reproduce, adapt, publish, translate and display that Submission, in whole or in part, in any medium, for marketing and any other lawful business purpose, without further consent, notice or compensation to you. You confirm that you have the right to grant this license and that your Submission does not infringe any third party’s rights.

Bonita is under no obligation to use, publish, return, or keep confidential any Submission, and may remove it at any time.

Third-party links, platforms, and impersonation

The Site links to, or is accessed by tapping through to, third-party platforms including WhatsApp, Google Maps, and social media. Bonita does not control and is not responsible for the content, availability, terms, or privacy practices of those third-party platforms, and linking to them does not imply endorsement.

Bonita advertises only from bonita.luxury and equivalent official Bonita domains, and contacts prospects only from an official Bonita email address, an official Bonita WhatsApp number, or the telephone numbers published on the Site. Bonita is not responsible for, and disclaims all liability arising from, websites, social media accounts, advertisements or communications that imitate Bonita or falsely claim to represent it. If you believe you have been contacted by such an impersonator, please report it to us using the contact details on this page.

Bonita sells directly through its own team. Where a transaction involves an independent, third-party real estate broker, that broker acts on its own account and is not Bonita’s agent or employee; Bonita is not responsible for representations made by an independent broker that go beyond what is stated in a signed agreement with the applicable seller entity.

No warranty

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR ACCURACY. BONITA DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Bonita may suspend, restrict, or discontinue the Site, or any part or feature of it, at any time and without notice, and is not liable for any consequence of doing so.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BONITA, ITS AFFILIATES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANTICIPATED SAVINGS, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SITE, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR ANY OTHER LEGAL THEORY, AND EVEN IF BONITA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BONITA’S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (US$100). THIS LIMITATION APPLIES ONLY TO YOUR USE OF THE SITE AND HAS NO EFFECT ON, AND DOES NOT LIMIT, ANY LIABILITY BONITA MAY HAVE UNDER A SEPARATE SIGNED RESERVATION OR PURCHASE-SALE AGREEMENT.

Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties, so some of the above limitations may not apply to you to the extent your jurisdiction’s law does not permit them; in that case, the limitation will apply to the fullest extent that law does permit.

Indemnification

You agree to indemnify, defend and hold harmless Bonita, its affiliates, and their respective officers, directors, employees and agents from and against any claim, liability, damage, loss, cost or expense (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site; (b) your breach of these Terms; (c) any Submission you provide; or (d) your violation of any law or of any third party’s rights.

Force majeure

Bonita is not liable for any failure or delay in the operation of the Site, or in responding to an enquiry, caused by circumstances beyond its reasonable control, including hurricanes and other severe weather, natural disasters, power or internet outages, acts of government, or failures of third-party platforms or service providers Bonita relies on to operate the Site.

Changes to these Terms and to the Site

Bonita may modify these Terms at any time by posting the revised Terms on this page and updating the date at the top. Changes take effect when posted. Your continued use of the Site after a change is posted constitutes acceptance of the revised Terms; if you do not agree to a change, your only remedy is to stop using the Site.

Bonita may also change, suspend, or discontinue any aspect of the Site at any time without notice or liability.

Governing law and jurisdiction

These Terms, and any dispute arising out of or relating to the Site or these Terms, are governed by the laws of the Dominican Republic, without regard to its conflict-of-law principles.

You agree that any dispute arising out of or relating to the Site or these Terms will be submitted to the exclusive jurisdiction of the competent courts of the Dominican Republic, and you irrevocably waive any objection to that forum on grounds of inconvenient forum or otherwise. This clause governs disputes about the Site only; a signed reservation or purchase-sale agreement may contain its own dispute-resolution provisions, which control for disputes arising under it.

General

Severability. If any provision of these Terms is held invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

No waiver. Bonita’s failure to enforce any right or provision of these Terms is not a waiver of that right or provision.

Assignment. Bonita may assign or transfer these Terms, in whole or in part, without restriction, including in connection with a sale, merger or reorganization of its business. You may not assign these Terms without Bonita’s prior written consent.

Entire agreement. As to your use of the Site, these Terms and our Privacy Policy are the entire agreement between you and Bonita and supersede any prior agreement on that subject, and do not affect the terms of any separate signed agreement you enter into with Bonita.

Language. These Terms are published in English and Spanish. If there is a conflict between the two versions, the Spanish version controls for users in the Dominican Republic and the English version controls otherwise, unless a separate signed agreement between you and Bonita states otherwise.
